The Office of Water Quality has developed a Nonrule Policy Document (NPD) concerning the implementation of ground water quality standards established under 327 IAC 2-11. The NPD provides the IDEM’s policy interpretation of the responsibilities and authorities of the various IDEM programs and other state agencies which have responsibilities for ground water protection. Areas addressed by the NPD include application of the ground water regulations when a person has caused water in a drinking water supply well to exceed a numeric criteria; application of the ground water regulations when a person causes the water in a non-drinking water well to have a contaminant concentration which renders the well unusable for its current use; consequences of a violation of 327 IAC 2-11-2(e) or (f); and application of the ground water quality standards to remedial activities.
The Office of Land Quality is seeking comments on the draft NPD through August 2, 2008. The NPD will be presented to the Solid Waste Management Board on September 16, 2008. The NPD may be viewed at www.in.gov/idem/files/nrpd_water-018.pdf.
